By using BluDMS services, you agree to our terms and policies. Please review these conditions carefully, as they define your rights and responsibilities while using BluDMS.
Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and BluAI, Inc. ("BluAI," "Company," "we," "us," or "our") governing your use of the BluScan mobile application ("App" or "BluScan").
By downloading, installing, or using BluScan, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
These Terms are in addition to and incorporate by reference the BluAI Terms of Service and Privacy Policy, which govern your use of the BluAI platform.
1. Description of Service
1.1 What BluScan Does
BluScan is a mobile application that enables you to:
- Scan medical documents using your device's camera
- Process and enhance scanned document images
- Organize scanned documents
- Upload documents to your BluAI account
1.2 BluAI Account Required
BluScan requires an active BluAI account. By using BluScan, you agree to comply with the BluAI Terms of Service and Privacy Policy.
1.3 Service Availability
We strive to maintain reliable service but do not guarantee uninterrupted availability. The App may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.
2. Eligibility
2.1 Age Requirements
You must be at least 18 years old to use BluScan independently. Users between 13 and 18 may use BluScan with parental or guardian consent and supervision.
2.2 Account Requirements
You must have a valid BluAI account in good standing to use BluScan.
2.3 Geographic Restrictions
BluScan is intended for use in jurisdictions where BluAI services are available. You are responsible for compliance with local laws regarding the use of digital health services.
3. User Responsibilities
3.1 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
3.2 Appropriate Use
You agree to use BluScan only for:
- Scanning your own medical documents
- Scanning documents you are authorized to possess and digitize
- Lawful purposes consistent with these Terms
3.3 Prohibited Activities
You agree NOT to:
- Scan documents belonging to others without proper authorization
- Use the App for any illegal purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Circumvent any security features of the App
- Use the App to transmit malware or malicious code
- Interfere with or disrupt the App or servers
- Use automated systems to access the App
- Impersonate any person or entity
- Use the App in any manner that could damage, disable, or impair BluAI services
4. Privacy and Security
4.1 Privacy Policy
Your use of BluScan is subject to our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.
4.2 Medical Information
You acknowledge that:
- Scanned documents may contain sensitive medical information
- You are responsible for ensuring you have the right to digitize and store such information
- BluAI implements security measures but cannot guarantee absolute security
4.3 Healthcare Disclaimer
BluScan is a document scanning and storage tool. It is NOT:
- A medical device
- A diagnostic tool
- A substitute for professional medical advice
- A healthcare provider
Always consult qualified healthcare professionals for medical advice.
5. Service Modifications
5.1 Updates
We may update the App periodically to add features, fix bugs, or improve performance. Some updates may be required for continued use.
5.2 Changes to Service
We reserve the right to modify, suspend, or discontinue any aspect of BluScan at any time. We will provide reasonable notice of material changes when possible.
5.3 Changes to Terms
We may revise these Terms from time to time. Material changes will be communicated through the App or via email. Continued use after changes constitutes acceptance.
6. Disclaimers
6.1 "As Is" Service
BLUSCAN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6.2 No Guarantee
We do not guarantee that:
- The App will meet your specific requirements
- The App will be uninterrupted, timely, secure, or error-free
- Scan results will be accurate or reliable
- Any errors will be corrected
7. Limitation of Liability
7.1 Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BluAI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data or documents
- Loss of profits or revenue
- Personal injury or property damage
- Unauthorized access to your information
- Interruption of service
- Errors or omissions in content
7.2 Cap on Liability
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF BLUSCAN SHALL NOT EXCEED THE AMOUNT YOU PAID TO BluAI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Introduction
BluAI, Inc. ("BluAI," "we," "us," or "our") is committed to protecting your privacy and the security of your personal health information. This Privacy Policy explains how BluScan ("the App") collects, uses, stores, and protects your information when you use our medical document scanning service.
Because BluScan handles medical documents and health-related information, we maintain strict privacy practices that meet or exceed industry standards for healthcare data protection.
Please read this Privacy Policy carefully. By using BluScan, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy.
1. Information We Collect
1.1 Information You Provide Directly
- Account Information: When you sign in to BluScan using your BluAI account, we access your account credentials, name, and email address to authenticate your identity.
- Scanned Documents: The medical documents you scan using the App, including but not limited to prescriptions, lab reports, medical records, insurance documents, and healthcare provider notes.
- Document Metadata: Information about your scanned documents, including file names you assign, dates of scanning, and any tags or categories you apply.
- Support Communications: Information you provide when contacting our customer support team.
1.2 Information Collected Automatically
- Device Information: Device type, operating system version, unique device identifiers, and mobile network information.
- Usage Data: How you interact with the App, including features used, scanning frequency, and app performance data.
- Log Data: Error reports, crash logs, and diagnostic information to help us improve the App.
- Location Information: With your permission, approximate location data may be collected to timestamp documents. You can disable this in your device settings.
1.3 Camera and Storage Access
- Camera: BluScan requires camera access solely to capture images of your medical documents. We do not access your camera for any other purpose.
- Photo Library: If you choose to import existing photos, we access only the specific images you select. We do not scan or access other photos in your library.
- Storage: Scanned documents are temporarily stored on your device before being uploaded to BluAI. Documents are encrypted during storage.
2. How We Use Your Information
We use your information for the following purposes:

- To scan, process, and enhance your medical documents
- To upload your documents securely to your BluAI account
- To sync your documents across your devices
- To provide document organization and search features
2.2 Service Improvement
- To analyze usage patterns and improve App functionality
- To diagnose technical issues and optimize performance
- To develop new features based on user needs
2.3 Communication
- To send important service notifications
- To respond to your support inquiries

3. How We Protect Your Information
3.1 Encryption
- In Transit: All data transmitted between BluScan and BluAI servers uses TLS 1.3 encryption.
- At Rest: Documents stored on your device and our servers are encrypted using AES-256 encryption.
- End-to-End: Your scanned documents are encrypted before leaving your device and can only be decrypted by authorized BluAI systems.

BluAI maintains administrative, physical, and technical safeguards designed to protect the privacy and security of Protected Health Information (PHI) in accordance with the Health Insurance Portability and Accountability Act (HIPAA) where applicable.
4.2 Your Health Information Rights
You have the right to:
- Access your scanned medical documents at any time
- Request deletion of your documents
- Export your documents in standard formats
- Know how your health information is used and shared
4.3 Limited Use
We do not:
- Sell your health information to third parties
- Use your medical documents for advertising purposes
- Share your health information without your consent, except as required by law
- Access the content of your documents for any purpose other than providing our services
5. Information Sharing
5.1 We Share Information With:
- BluAI Platform: Your scanned documents are uploaded to and stored within your BluAI account, subject to BluAI's Privacy Policy.
- Service Providers: We work with carefully selected third-party service providers who assist us in operating the App (e.g., cloud hosting, analytics). These providers are contractually obligated to protect your information and may only use it to provide services to us.
- Legal Requirements: We may disclose information if required by law, court order, or government regulation, or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
5.2 We Do Not:
- Sell your personal information or medical documents
- Share your information with advertisers
- Allow third parties to use your data for their own marketing purposes
6. Data Retention
6.1 Document Storage
Your scanned documents are retained in your BluAI account until you choose to delete them. You maintain full control over your documents.
6.2 Account Data
We retain your account information for as long as your BluAI account remains active.
6.3 Temporary Data
- Cached images on your device are automatically deleted after successful upload
- Processing logs are retained for 90 days for troubleshooting purposes
- Analytics data is retained in anonymized form
6.4 After Account Deletion
When you delete your BluAI account, we delete your personal information within 30 days, except where retention is required by law or for legitimate business purposes (e.g., fraud prevention).
7. Your Privacy Rights
7.1 Access and Portability
You can access your scanned documents at any time through the BluAI platform. You may export your documents in standard formats (PDF, JPEG).
7.2 Correction
You can update your account information through BluAI settings.
7.3 Deletion
You can delete individual documents or request complete account deletion. To delete your account, contact support@BluAI.com.
7.4 Opt-Out
You can opt out of non-essential data collection through App settings. Note that some data collection is necessary for the App to function.
7.5 California Residents (CCPA)
California residents have additional rights under the California Consumer Privacy Act, including the right to know what personal information is collected, the right to delete, and the right to opt-out of sales (though we do not sell personal information).
7.6 European Users (GDPR)
If you are in the European Economic Area, you have additional rights including data portability, restriction of processing, and the right to lodge a complaint with a supervisory authority.
8. Children's Privacy
BluScan is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at privacy@BluAI.com.
For users between 13 and 18, parental or guardian consent may be required depending on your jurisdiction.
9. International Data Transfers
Your information may be transferred to and processed in countries other than your country of residence. These countries may have different data protection laws. When we transfer your information, we ensure appropriate safeguards are in place, including standard contractual clauses approved by relevant authorities.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by:
- Posting the updated policy in the App
- Sending you an email notification
- Displaying a prominent notice when you open the App
Your continued use of BluScan after changes become effective constitutes acceptance of the revised Privacy Policy.
